Reporting Copyright Infringement

Required Elements of a Valid DMCA Notice

To be considered valid under the DMCA, your written notice must include ALL of the following elements (17 U.S.C. § 512(c)(3)):

1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notice, a representative list of such works.
2. Identification of the infringing material: A description of the material you claim is infringing that is reasonably sufficient to permit us to locate the material. Please include the specific URL(s) on mentionthis.xyz where the allegedly infringing content appears.
3. Your contact information: Your name, address, telephone number, and email address so that we can contact you.
4. Statement of good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Statement of accuracy: A statement that the information in your notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
6. Physical or electronic signature: A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Our Response Process

Upon receipt of a valid, complete DMCA notice, MentionThis will:

1. Promptly remove or disable access to the allegedly infringing material;
2. Notify the user who posted the material that it has been removed;
3. Provide the user with an opportunity to submit a counter-notification;
4. Forward a copy of the counter-notification to the original complainant;
5. Restore the material within 10–14 business days unless the complainant notifies us they have filed a court action.

Counter-Notification Procedure

If you believe that material you posted on MentionThis was removed due to a mistake or misidentification, you may submit a counter-notification under 17 U.S.C. § 512(g). Your counter-notification must include:

1. Your physical or electronic signature;
2. Identification of the removed material and the location at which it appeared before removal (the URL);
3. A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification;
4. Your name, address, and telephone number;
5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which MentionThis may be found), and that you will accept service of process from the person who provided the original DMCA notice or their agent.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. The content may be restored within 10–14 business days unless the complainant files a court action.

Repeat Infringer Policy

MentionThis has adopted a policy of terminating, in appropriate circumstances and at our discretion, users or contributors who are deemed to be repeat infringers. MentionThis may also, at its discretion, limit access to the website and/or terminate accounts of users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
